The type of personal information we collect

We currently collect and process the following information:

​

  • Personal identifiers, contacts and characteristics (for example, name and contact details when signing a model and/or image release form)

  • Likeness of an individual, whether in a video recording, photograph, drawing or other visual presentation so long as it is enough to evoke the individuals identity in the public domain.

 

YOUR personal information and why we have it

​

Most of the personal information we process is provided to us directly by you for one of the following reasons:

​

  • You have appeared in video or photograph during a production arranged by Ian Edward Thorpe Studio Ltd or one of our clients or suppliers.

  • Your personal information and/or likeness have been sent to us as an asset for production by one of our clients or suppliers with your permission.

  • If you are under the age of 16, a parent or legal guardian has consented for your personal information and/or image likeness to be used.

We also receive personal information indirectly, from the following sources in the following scenarios:

​

  • An appearance in the background of a production where measures have been put in place to make the general public aware, yet image likenesses has been inadvertently captured in video recording or photograph.

  • Footage or image assets supplied by our clients or suppliers that have been cleared for usage by a third party or have been purchased from a stock library.

  • Sensitive personal data may have been captured by a device that has a wide view over public domain, e.g. drone, wide angle action camera, or surveillance camera.

We use the information that you have given us in post-production to create videos, imagery and graphics to meet our clients purposes.

We may share this information with:

  1. The client or supplier that the production relates to if your personal information, contacts and characteristics have been processed in a model/image release.

  2. Prospective clients in previous work examples or showreels and on our website thorpe.studio. This specifically regards visual and audible likeness, unless the individual or legal guardian, client or supplier has withdrawn consent for this usage.

Under the UK General Data Protection Regulation (UK GDPR), the lawful bases we rely on for processing this information are:

​

(a) Your consent. You are able to remove your consent at any time, and if you are under the age of 16 consent can be withdrawn with or without representation of a parent or legal guardian. You can do this by contacting ian@thorpe.studio.

(b) We have a contractual obligation.

(c) We have a legal obligation.

(d) We need it to perform a public task.

(e) We have a legitimate interest.

 

How we store your personal information

Your information is securely stored for a period of up to 7 years unless otherwise stipulated in a model/talent/image release contract. Sensitive information, especially that regarding children under the age of 16, can be erased immediately upon request.  

Personal identifiers, contacts, and characteristics will be erased from digital copies and paper documents will be destroyed upon completion of the production or the expiration of the release agreement.

Image likeness can be taken down from the public domain at request and either removed from the video, photograph or graphic, or permanently erased.

 

Your data protection rights

Under data protection law, you have rights including:

Your right of access - You have the right to ask us for copies of your personal information. 

Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete. 

Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances. 

Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances. 

Your right to object to processing - You have the the right to object to the processing of your personal information in certain circumstances.

Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
